Encroachment means any physical obstruction and any structure or object of any kind or character placed, without the authority of law, either in, under, or over any City street or any other public property in which the City has an easement or other interest (O.M.C. 12.64.010). An Encroachment Permit is issued by the Director of Public Works for the purpose of encroaching within public rights-of-way.
Public right-of-way is typically bounded at both sides by property lines, which often includes sidewalks and parkways.
The Encroachment Permit is governed by Orange Municipal Code, Section 12.64. Street cut regulations are described in Section 12.20.

Encroachment Permits are issued at the Public Works Front Counter at City Hall, 300 E. Chapman Avenue, Orange. (714) 744-5525.
The permit can be either filled out by hand or prepared on the computer. The permit form is available in Microsoft Word format. A hardcopy of the permit application should be submitted to the Public Works front counter. F AX transmittal is discouraged because of its poor reproduction quality.
A permit number will be assigned at the time of submittal.
The following items should be included in addition to the permit application form:
Certificate of Insurance
Improvement plan (when required)
Traffic control plan (when required)
The improvement plan and traffic control plan will not be accepted for plan check without an Encroachment Permit application.
All submittals must be processed through the Public Works front counter. Plans should NOT be sent directly to an individual in the department for review.
