Definitions

Encroachment means any physical obstruction and any structure or object of any kind or character placed, without the authority of law, either in, under, or over any City street or any other public property in which the City has an easement or other interest (O.M.C. 12.64.010). An Encroachment Permit is issued by the Director of Public Works for the purpose of encroaching within public rights-of-way. Public right-of-way is typically bounded at both sides by property lines, which often includes sidewalks and parkways.

The Encroachment Permit is governed by Orange Municipal Code, Section 12.64. Street cut regulations are described in Section 12.20.

Procedure

Encroachment Permits are issued by emailing pwpermits@cityoforange.org.

Permit Form

The permit can be either filled out by hand or prepared on the computer. An electronic copy of the permit application should be submitted to pwpermits@cityoforange.org.

A permit number will be assigned at the time of submittal.

Additional Items

The following items should be included in addition to the permit application form:

• Certificate of Insurance
• Improvement plan (when required)
• Traffic control plan (when required)

The improvement plan and traffic control plan will not be accepted for plan check without an Encroachment Permit application.

Grading requirements are described in the City of Orange Grading Manual (O.M.C.16.40) and in the 2016 California Building Code.

Prior to issuance of a Grading Permit, grading plans, and supporting documents must be prepared and submitted for review to Development Services. Please review the Grading Permit – Submittal Packages Checklist which is located in the Grading Documents section in order to prepare a grading plan submittal.

To register as a new permit holder with the Citation Processing Center, upload the required documents; a government issued ID, current utility bill, or for Chapman University students, submit your enrollment verification letter, government issued ID, and utility bill.

You should receive an email within 24-48 hours verifying your permit was approved or denied. If approved, submit your payment and the permit will be mailed to you within seven days.

FAQs 

Where are these banners hung?
Old Towne Plaza Historic District, including 1 block north and south on Glassell Street from the Plaza; and two blocks east and west on Chapman Avenue from the Plaza.

Who can request to hang banners?

Nonprofit groups may request to hang banners.

Who installs the banners and how long can the banners be up?

City crews will install and remove banners, and they may be hung a maximum of 30 consecutive days.

What can I put on the banner?

Banners promote specific nonprofit events, such as fundraising activities, athletic team enrollment periods, youth programs, parades, festivals and other civic events. Banners of a political, commercial or non-community related nature are prohibited.

Is there any time of the year banners are not allowed to be hung?

Yes, there are two times a year when we do not allow banners. These are the month of August, when the Street Fair banners are up; and December, when holiday decorations are up.

What is the appropriate size of a banner?

Specifications of banners are shown in Standard Plan No. 416, and as noted below.

• 20 feet length
• 3 feet height
• 3/8 inches nylon rope to be sewn into top & bottom of banner. Top rope to be length of banner knotted on each end to prevent slipping. The bottom rope shall extend 28 feet beyond each end.
• Top of banner shall be double sewn with grommets placed at 17 inches on center and one at each end.
• Banner shall be constructed of 16, 18 or 20 ounces vinyl only (no canvas).
• Wind relief pockets to be cut into banner.

Is there a fee for installing banners?

The applicant pays a $200 fee for installation and removal of a banner by City staff.

What insurance coverage do you need?

A certificate of liability insurance shall be provided at the time of application providing a combined single limit of $100,000 per incident for property damage and $500,000 per person per incident and for bodily injury. The City is to be declared additional insured under the terms of the policy.

Can banners be used more than once?
Yes, if you tell your sign shop that you will be reusing the banner they can use removable vinyl lettering.

Transportation Permits allow for the monitoring of truck traffic throughout the City, and to minimize the potential of damage to City infrastructure by oversize and overweight vehicles.

Fees

$16 for each truck involved in the hauling operation, valid for the duration of the permit. This is not a daily charge. (Five trucks multiplied by $16 for 90 days = $80)

$5,000 clean-up deposit to be refunded upon completion of hauling activities, after inspection by the City.

The Well Permit is intended to protect our groundwater reserves from any contamination. It is required for all vertical drilling, deep or shallow.

In addition to water well drilling, well permits are required for soil sampling, soil contamination monitoring, and other non-water related drilling. An approved Well Permit is required before any Encroachment Permit, or other permit, can be issued for vertical drilling works.
