The Mandatory Commercial Recycling Law (AB 341) states that businesses, including public entities, generating four cubic yards or more of commercial solid waste per week or a multifamily residential dwelling of five units or more shall arrange for recycling services starting July 1, 2012.

Businesses can take one or any combination of the following to divert solid waste from disposal: self-haul, subscribe to a hauler(s), arrange for the pickup of recyclable materials, or subscribe to a recycling service that may include mixed waste processing that yields diversion results comparable to source separation. Businesses that generate more than 4 cubic yards of waste to provide their customers with recycling containers that are visible, accessible, and adjacent to each trash container. The California Legislature passed Mandatory Commercial Organics Recycling Assembly Bill 1826 (AB 1826) in 2014. This law requires all businesses and commercial centers that generate a certain amount of organic waste to develop a program to recycle that waste rather than sending it to a landfill. Organic waste includes food waste, vegetable trimmings, plate scrapings, spoiled food, and excess food inventory. The State regulations require that:

If you are interested in donating excess edible food, contact the Abound Food Care. California law under SB:1383 Short-Lived Climate Pollutants requires food generators to participate in an edible food recovery program. This program is offered free of charge to Orange businesses.

Tier 1 Commercial Edible Food Generators must meet this edible food recovery requirement by January 1, 2022. Examples of businesses in tier 1 include:

• Supermarkets with revenue ≥ $2 million.
• Grocery Stores with Facilities ≥ 10,000 sq. ft.
• Food Service Providers
• Food Distributors
• Wholesale Food Vendors

Tier 2 Commercial Edible Food Generators must meet this edible food recovery requirement by January 1, 2024. Examples of businesses in tier 2 include:

• Restaurants with Facilities ≥ 5,000 sq. ft. or 250+ seats
• Hotels with an On-Site Food Facility and 200+ Rooms
• Health Facilities with an On-Site Food Facility and 100+ Beds
• Large Venues and Events
• State Agency Cafeterias with Facilities ≥ 5,000 sq. ft. or 250+ seats
• Local Education Agency with an OnSite Food Facility
• Non-Local Entities

A list of Food Recovery Organizations is also available should you wish to donate your edible food directly. Please ensure you are following the reporting regulations to ensure your recovered food is counted.

Materials generated from construction projects must be recycled to meet statuary obligations under various State legislation and California Green Building Codes, which require 65% of all debris to be diverted from the landfill. To meet reporting obligations, the City of Orange requires individuals pulling permits with construction and demolition debris to provide information on where the materials will be taken and the percentage of materials diverted from the landfill.

As a secondary option, the Building Division has a self-hauling reporting form under Forms, where applicants are responsible for reporting diversion.

The City of Orange is part of the Orange County Recycling Market Redevelopment Zone (OC RMDZ) which is administered by the City of Fullerton. In 1990, the State of California (State) adopted Senate Bill (SB 2310) to establish the Recycling Market Development Zone (RMDZ) program. The purpose of SB 2310 was to simultaneously increase recycling and reinforce the State’s economic development infrastructure through the enhancement, attraction, retention, and expansion of business that manufacture products from recyclable materials. The RMDZ program encourages reuse and utilization of recycled and recyclable materials to create new businesses, expand existing businesses by diverting solid waste from landfills. Eligible businesses within an RMDZ may apply for low interest loans and receive free business-to-business product marketing.

To properly dispose of your used motor oil at one of Orange's certified collection centers, search for the center nearest you at OC Health's website. It is a good idea to call the collection center to verify their hours and make sure they are able to accept your used oil. This program is funded by a grant from CalRecycle and administered by Orange County Health Care Agency.

New development applications are required to provide a Trash, Recycling, and Organics (TRO) Estimate Form. This letter should outline the generation of trash, recyclables, and organics in cubic yards per week. Even if the generation is negligible please state so in the letter. Each of the three solid waste categories should be shown in cubic yards per week. A business that generates food is required to participate in an edible food recovery program.

Included in the letter should be an explanation of how each form of solid waste will be managed. This may include service through CR&R, self-haul, or organic diversion through food donations.
